Actuate Corporation (“Actuate”) and its affiliates respect your privacy and are committed to protecting your personal information. This Privacy Statement describes the types of information Actuate collects from users including from users of our Web-enabled products, the way Actuate handles such information, and the choices you may have with respect to Actuate’s collection and use of your information. You are strongly encouraged to read the Actuate Privacy Statement prior to, and periodically during, your use of Actuate’s products and services.
How We Collect Information
Actuate collects information in a variety of online and offline ways including through your use of the Actuate website, offline and on-line registrations and forms related to community registration, subscriptions for content notifications, web seminars, seminars, events, conferences, sweepstakes, contests, or other promotions, whitepapers, product purchases or trials, and other oral and written communications and interactions.
Personal Information We May Collect

Registration Data, Technical Data and Usage Data are collectively referred to in this Privacy Statement as “Account Data.” You agree to provide accurate, current and complete Registration Data and to update the Registration Data as required to keep it accurate, current and complete at all times. Actuate may terminate your rights to or alter the availability of any or all of the products and services if any Registration Data you provide is false, inaccurate or incomplete. You agree that Actuate may collect, process and store the Registration Data you provide for use in maintaining your Account, and to otherwise use your Registration Data and other Account Data as set forth in this Privacy Statement.
Information Regarding Transactional and Website Use and Participation in Marketing Events
Actuate allows individuals to register on our website(s) and complete a website profile for transactional, marketing and commercial purposes. You may choose whether to complete a registration profile or to become a member of any available community, newsletter or event. While some of the required Registration Data is voluntary, some information is required for you to access areas of our website(s) or take advantage of certain offers or services. If you do not wish to disclose that Registration Data, you may not be able to access such restricted areas of take advantage of all offers or services.
Actuate also collects information regarding your transactions, and interest or participation in website(s), events, webcasts, training, conferences, or our communities, such as:

Actuate uses “cookies” to help us gather statistics about our website usage and tailor our interactions with you. Web beacons or other technologies may be used on a number of pages on Actuate’s websites to help analyze the effectiveness of our websites and provide you with better service. Other Information We Collect
Actuate may also collect information including system and infrastructure information, applications installed, usernames and passwords for Actuate applications, license key information, download and installation data, performance information, operational logs, product related files, and location of files within the Actuate infrastructure.
How Actuate Responds to Do Not Track Signals from Web Browsers
Actuate does not engage in user tracking across third party websites. We therefore do not proactively seek to detect or respond to web browser “do not track” signals or other such mechanisms that provide users the ability to exercise choice regarding the collection of personally identifiable information across third party websites. Should your browser have a “do not track” signal, we will still be able to provide products and services to you through our website registration process.

Actuate does not sell or lease your personal information. We will not share any personally identifiable information except as set out in this Privacy Statement, unless required by law or legal process, to protect and defend our rights or property, if provided by you on or offline, or under exigent circumstances to protect the personal safety of Actuate website users or the public, without first obtaining consent.
Actuate is a global organization with business processes, management structures and technical systems that cross borders. We may share information within Actuate to countries in the world where we do business with connection with the above uses and this Privacy Statement.
Actuate may share information with its affiliates, subsidiaries, partners, third parties, agents, bonding houses, and suppliers to collect, use, analyze and process information on Actuate’s behalf and to support our business and marketing purposes. We will only provide those third parties with information that is necessary for them to perform the services.
Actuate engages outside agencies and partners for advertising and marketing purposes. Any information shared with our advertising partners is aggregated and does not include personally identifiable information. Actuate engages in paid search ads and runs banner ads on third party websites.
Any information that you disclose in any chat rooms, forums, blogs, message boards and/or news groups or communities could be made public and users are asked to exercise caution when deciding to disclose personal information.
Consent to Transfer and Disclosure of Account Data. By using Actuate’s products and services, you hereby unambiguously consent to the collection and processing of your information by Actuate and to the transfer of your information, as necessary, across national borders, including, but not limited to, to and from Actuate’s headquarters in the United States. You further agree and give Actuate the right, without liability to you, to disclose your information to law enforcement authorities, government officials, and third parties, that Actuate believes is reasonably necessary or appropriate including, but not limited to, Actuate’s right to cooperate with any legal process in relation to your use of our products and services, any third party claim that your use of our products is unlawful or infringes such third party’s rights, etc.
U.S.-EU and U.S.-Swiss Safe Harbor Privacy Frameworks
Actuate adheres to the U.S.-EU and U.S.-Swiss Safe Harbor Agreements concerning the transfer of personal data from the European Union or European Economic Area and Switzerland. Accordingly, we follow the Safe Harbor Principles published by the U.S. Department of Commerce, the European Commission, and the Federal Data Protection and Information Commissioner of Switzerland with respect to all such data. As part of this commitment, Actuate clearly informs individuals that their data is being collected and explains how it’s being used, including the option to refuse the forward transfer of this information to third parties. Any approved transfers of data to a third party may only occur to other organizations that follow adequate protection principles. Data collected by Actuate will be relevant and reliable for the purpose for which it was collected, and reasonable efforts will be made to protect the collected information. Individuals will have ample opportunity to access, correct, amend or delete information held about them, except where the burden of providing access is disproportionate to the risk of their privacy. Actuate will conduct compliance audits of its relevant privacy practices to verify adherence to these policies. Actuate is committed to resolving any disputes that may arise by internal investigation and efficient resolution. As part of our participation in the Safe Harbor, for complaints that cannot be resolved between Actuate and the complainant, we will cooperate with the following dispute resolution bodies to address individual complaints regarding privacy issues: (i) for Customer complaints, we cooperate with the International Centre for Dispute Resolution in accordance with its applicable commercial rules; (ii) for complaints concerning our handling of Employee Personal Information, we cooperate with the European Union Data Protection Authorities and/or Swiss Data Protection Authorities. If you have complaints regarding our compliance, you should first contact our Chief Compliance Officer at our corporate headquarters. Actuate’s adherence to these privacy principles may be limited to the extent necessary to meet regulatory, legal, governmental or national security obligations.
